SETTLEMENT AGREEMENT

ARBITRATION CASE NO.97-09951

Failure to Provide Records and Documents Generated by Drug Testing

The American Federation of Government Employees (AFGE) Council 214 and the Air Force Materiel Command (AFMC) hereby agree to the following settlement in arbitration case number 97-09951:

AFMC recognizes that the drug testing information at issue in this grievance should have been provided to the employee upon request, or to the employee's representative if requested by the employee, in accordance with the parties' Memorandum of Agreement on Air Force Civilian Drug Testing Program Implementing Procedures and Change 1 AFR 40-750, 22 December 1989, dated 3 July 1990.

AFMC agrees to comply with the above referenced Memorandum of Agreement in the future, specifically paragraphs 6(d), 25, and 26 as they relate to this grievance.

A copy of this settlement agreement will be forwarded to all labor attorneys and labor relations officers at bases covered by the Master Labor Agreement (MLA) in addition to the attorney involved in this case. Should this attorney again be assigned in labor law to a base covered by the MLA, she will be reminded of the provisions of the above mentioned Memorandum of Agreement, specifically paragraphs 6(d), 25, and 26.

It is understood by the parties that this settlement agreement resolves this grievance, and the arbitration hearing will therefore be cancelled. The parties agree that any cancellation fee will be borne equally by the Employer and the Union.
