MEMORANDUM OF UNDERSTANDING
BETWEEN
THE DEFENSE INFORMATION SYSTEMS AGENCY
AND
THE AMERICAN FEDERATION OF GOVERNMENT EMPLOYEES
THE NATIONAL ASSOCIATION OF GOVERNMENT EMPLOYEES
THE NATIONAL FEDERATION OF FEDERAL EMPLOYEES

(1) The Defense Information Systems Agency (DISA) and The American Federation of Government Employees (AFGE), National Association of Government Employees (NAGE), and National Federation of Federal Employees (NFFE) hereby agree to the following in order to facilitate the smooth capitalization of personnel to DISA pursuant to Defense Management Report Decision (DMRD) 918, ensure effective mission accomplishment, and create a cooperative labor relations environment that is mutually beneficial to employees and the Agency.

(2) DISA agrees to continue to honor the terms of current collective bargaining agreements to the maximum extent possible, pending the resolution of any questions of representation which may be raised as a result of the DMRD 918 capitalization, except where current language (a) is in conflict with DISA-wide programs or regulations, and/or (b) references losing organizations or agencies for resolving issues. Any changes or alterations to local agreements will be brought to the attention of DISA Headquarters. DISA agrees to communicate and consult with the National Headquarters of AFGE, NAGE, and NFFE prior to the implementation of such changes. DISA also agrees to honor the terms of supplemental and I & I agreements (as applicable to DISA employees) to the maximum extent possible. DISA will bargain with respect to changes in working conditions at the local level.

(3) DISA will observe the grievance/arbitration process described in current collective bargaining agreements, so long as decisions are made by DISA officials (or officials designated by DISA) and the matter of concern or dissatisfaction arises out of employment with DISA.

(4) DISA will continue to withhold dues from capitalized employees, and will process new applications for dues deduction in accordance with current negotiated agreements. This dues withholding arrangement is made in a good faith effort to facilitate a smooth transition.

(5) AFGE, NAGE, and NFFE agree to withhold filing unfair labor practice (ULP) charges concerning or involving questions of representation, until final resolution of such questions of representation.

(6) Employees who are capitalized and are receiving their pay and/or other items through Electronic Funds Transfer will remain in that system of payroll distribution after capitalization.

(7) This memorandum of understanding is not intended by the parties to constitute the basis for the formation or continuation of a past practice on the part of the parties. The understanding is solely for the purpose of ensuring the stability of labor relations and the well-being of Agency employees until the representation issues raised by the capitalization of personnel to DISA are decided.

(8) The terms of this memorandum of understanding are effective to the extent that petitions are filed with the Federal Labor Relations Authority, no later than 60 days after capitalization (unless extended by mutual agreement), requesting a decision with respect to the representation issues arising as a consequence of DMRO 918.
