MEMORANDUM OF AGREEMENT (MOA) CONCERNING

Implementation of OMB Circular A-76 (Revised) May 29, 2003

1. The American Federation of Government Employees (AFGE) Council 214 and Air Force Materiel Command (AFMC), hereafter referred to as the Union and Management, hereby enter into this MOA regarding the above matters as they apply to AFGE bargaining unit members covered by the Master Labor Agreement (MLA) between the Parties.

2. The Parties agree that their current 22 November 2000 Memorandum for Agreement Concerning Air Force Instruction (AFI) 38-203/Commercial Activities Program dated 1 August 2000 will remain applicable to the AFGE Council 214 bargaining unit except in those instances where the MOA provisions are in conflict with the 0MB Circular A-76 (Revised) dated May 29, 2003. Where there is a conflict with the provisions of the current MOA, the 0MB Circular A-76 (Revised) dated May 29, 2003 provisions will take precedent.

3. All remedies available under the MLA or 5 U.S.C. Chapter 71 are available to the Parties if either party believes the other has failed to comply with any of the requirements of this MOA.
