MEMORANDUM OF AGREEMENT (MOA)
On
Court Reporter Utilization
1. American Federation of Government Employees (AFGE) Council 214 and Air Force Materiel Command (AFMC), hereafter referred to as the Union and Management, hereby enter into this MOA regarding Court Reporter Utilization as it applies to bargaining unit employees in matters covered by the Master Labor Agreement (MLA) between the Parties.
2. As directed by AFLOA/JAJ memorandum dated 30 June 2008, the Air Force will adopt a centralized approach to management of the court reporting program. This centralized approach is intended to effectively apportion court reporter transcription workload. The AFLOA/JAJ Superintendent will have tasking authority to make all assignments of court reporters to assist in transcribing electronic files (file sharing) and/or assigning court reporters to travel to a base (TDY) to record and transcribe a proceeding. This paragraph is back ground only.
3. To minimize the adverse effects on impacted bargaining unit employees (BUEs), management agrees to the following:
a. Assignments requiring TDY will be conducted in accordance with Article 22 of the MLA.
b. The AFLOA/JAJ Superintendent shall make court reporter TDY assignments in coordination with the Employee’s supervisor.
c. Accommodations will be made for hardship situations.
d. TDY assignments will be given on a voluntary basis, to include overseas travel.
4. All remedies available under the MLA or 5 U.S.C. 71 will remain available to the parties if concerns cannot be cooperatively resolved.
