MEMORANDUM OF AGREEMENT (MOA) ON AFI 36-802

Pay Setting (1 Sep 1998)

 

1.      American Federation of Government Employees (AFGE) Council 214 and Air Force Materiel Command (AFMC), hereafter referred to as the Union and Management, hereby enter into this MOA regarding subject instruction as it applies to bargaining unit members in matters covered by the Master Labor Agreement (MLA) between the Parties.

 

2.      The parties acknowledge that negotiations on AFI 36-802, Pay Setting, 1 Sep 98 are stagnant.  The parties hereby recognize that some AFMC installations have been using this AFI for sometime.  For those installations, there is no additional bargaining required.  For installations that are still using the Air Force pay setting regulations issued prior to 1998 they should proceed with implementation of this AFI.  They will identify any substantive policy changes brought about by implementation of this AFI and provide written notification to their local union of such changes.  The local union may request to bargain the substantive changes IAW the MLA 33.03.  Issues that can not be resolved by the local parties will be forwarded to AFMC/A1ZL and AFGE C-214 for resolution.  If the Command Parties cannot resolve the disputes the local parties may resolve the issue(s) through the traditional local procedures for resolving disputes.

 

3.      Add the following sentences to Paragraph 3.1.2/Supervisors:  “Compensate employees required to work during non-duty hours in accordance with applicable policies/procedures and union agreements.

 

4.      Remove from Paragraph 3.2/Recording TDY Travel Requirement the words “when requested” at the end of the third sentence.”

 

5.      Add the following sentence to Paragraph 4.1/Introduction:  “Local civilian personnel flights will follow the 21 Sep 06 DoD plan IAW 5 CFR 575.

 

6.      All remedies available under the MLA or 5 U.S.C. Chapter 71 are available to the Parties if either party believes the other has failed to comply with any of the requirements of this MOA.
